Election Laws in Texas
Our aggressive lawyers have extensive knowledge of local courts and Texas state election laws. Election recount efforts and election contests are governed, in part, by the Texas Election Code. Title 13 of the Texas Election Code specifies the rights and responsibilities of candidates seeking an election recount. Title 14 of the code does the same for candidates seeking an election contest.
These laws make very clear that election authorities have a responsibility to ensure fair elections. A candidate seeking to enforce the law or challenge violations has the right to seek a writ of mandamus against election officials. With some exceptions, the district court has original jurisdiction to hear election contests.
